Terms and Conditions Agreement

This Agreement governing the terms and conditions of your use of Clean Island Cans service is between you (“you” or “Customer”), as an authorized user of such services, and Clean Island Cans (“The Service”).

This Agreement, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Clean Island Cans (collectively, the “Agreement”), constitutes the entire agreement between Clean Island Cans and you regarding the Clean Island Cans cleaning service. By using the Service, you confirm your acceptance of and agree to be bound by this Agreement.

Service 

Clean Island Cans offers the Service at its website https://cleanislandcans.com. The Service is a mobile trash can and recycle can cleaning service that initiates a recurring subscription by selecting any of the recurring service plans. This subscription renews automatically unless canceled in writing and delivered by email to [email protected]

Cleaning Day is the day after bins are emptied by the trash or recycle hauler. This is to ensure empty bins when we arrive. Cleaning days will be communicated in advance by text and/or email.

We run a route that is dynamic each day. It is impossible to set a time window for cleaning as the route changes and is updated after each stop. The route and order depends on our work load, traffic, water stops, customer additions or deletions, amongst many other factors that make up our day. Please leave cans curbside and empty the entire day. 

Customer Responsibilities 

Clean Island Cans provides email and/or SMS text messages for notifications regarding your service; please ensure that [email protected] and [email protected] are whitelisted to ensure that Clean Island Cans communications are not sent to your junk email folder. 

In order for Clean Island Cans to provide its services, the customer must abide by the following conditions. Failure to do so may result in service delays, postponement, or cancellation. 

  • The day of service the trash cans must be at the curbside by 8:00 a.m.. Our curbside service hours are between 8:00 a.m. and 6:00 p.m.
  • Cans must be completely empty, with the exception of small pieces of trash stuck to the bottom.
  • Cans must be free of all trash, yard clippings, diapers, or animal waste.
  • Cans must be free of hazardous waste including chemicals, motor oil,  paint, glue, or other adhesives.
  • Cans must be free of building materials like plaster, stucco, or concrete.

If any of the above conditions are not met, Clean Island Cans will not perform the service(s) and the customer is still responsible for payment.  If Clean Island Cans was not able to perform the service, a message may be sent to the customer via email and/or text with an explanation.

Additionally, the customer understands that Clean Island Cans will make every effort to get all debris out of the cans, but certain substances require several treatments to be completely removed.  Certain substances are permanent, and some stains can not be removed.  Examples include scuff marks on the exterior of the bin (from trash hauler equipment) and material build up inside of the bin.

The customer understands that flies and maggots are common in trash bins. We attempt to remove all existing maggots, flies, and their larvae, but do not guarantee the elimination of an infestation. Customer understands that maggots may return in bins that have been cleaned. It only takes one fly to lay eggs; and one day for these eggs to become maggots.

Customer will allow Clean Island Cans to utilize the driveway for the cleaning process when necessary for safety reasons (Busy Road or unsafe area to work on street) or to comply with town Code and/or ordinance. Clean Island Cans will refuse to work on certain roads that present a danger to employees or assets.  The customer’s driveway may be utilized in certain circumstances, and the customer releases Clean Island Cans from any and all damages. 

Customer understands that some overspray may occur during the cleaning process and releases Clean Island Cans from any responsibility of damages to property. Clean Island Cans will take reasonable care to avoid damage.

Rescheduling Service

 If your can(s) cannot be serviced on the scheduled day, please notify us 48 hours prior to your scheduled service day and we will reschedule your cleaning for the next available service day.  If you do not notify us, we will attempt service, and if we’re unable to clean, you’ll be notified and charged for the service.  

Cancellation of Service

Cancellations must be made in writing and delivered by email to [email protected]. Cancellation notifications must be received prior to your next scheduled day of service. There are no refunds if notification of cancellation is not given in writing and prior to your next scheduled service day.  

Clean Island Cans’ Responsibilities 

If Clean Island Cans fails to provide its service on the scheduled day for a reason other than the customer failing to meet their responsibilities, Clean Island Cans will compensate the Customer by one of the following methods at its sole discretion:

  • Arranging for the service to be performed on the next possible service day.
  • Crediting the customer for the missed service.

Damaged Cans Policy 

Clean Island Cans is not responsible for any damage to trash cans resulting from pre-existing conditions, normal wear and tear, or structural weaknesses. Our cleaning process uses hot/high-pressure water and eco-friendly detergents, which are safe for standard waste bins. If a can is already cracked, weakened, or structurally compromised, Clean Island Cans assumes no liability for further damage and reserves the right to not clean any damaged cans. Customers are encouraged to inspect their cans before and after service and report any concerns directly to Clean Island Cans.

Modifications to Customer Agreement 

Clean Island Cans may amend this Agreement at any time by (a) posting a revised Customer Agreement at https://cleanislandcans.com and/or (b) sending information regarding the amendment to the email address provided to Clean Island Cans by customer.

Modifications to Service 

Clean Island Cans reserves the right to modify our service delivery for the betterment of our clients and the overall success of the service program.

Charges 

You agree to pay all charges for your use of the service at the prices in effect for your area of residence at the time of sign-up. Clean Island Cans reserves the right to change prices or institute new charges. Any changes in pricing will be communicated to you by telephone, mail, or email.

Payment for your first service is due at the time you sign up and agree to any of our recurring service plans. All future payments are due and will automatically be charged 7 days prior to your next scheduled service. If payment is declined, you agree to pay all amounts due upon demand.

You may opt out of future recurring charges at any time as long as notice is received before the next billing date by canceling via email at [email protected]. If you cancel before the minimum number of cleaning services are performed, you authorize Clean Island Cans to charge the credit card on file for the difference between the recurring service price selected and the remaining minimum number of cleanings published for that service type. The monthly service currently has a 4-cleaning minimum. The quarterly service currently has a 3-cleaning minimum.

Clean Island Cans reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges.

Miscellaneous 

The failure of either party to enforce its rights under this Agreement shall not be construed as a waiver of such rights. If any provision of this Agreement is held to be illegal or unenforceable, the validity of the remainder shall not be affected.

Neither party shall be liable for failure to perform due to circumstances beyond its reasonable control, including but not limited to acts of God, war, civil unrest, or industrial disputes. If such failure continues for at least 30 days, the affected party may terminate this Agreement by written notice to the other party.
